Siyasal tarihimizde halk\u0131n siyasal kat\u0131l\u0131m\u0131n\u0131 demokratik siyaset gere\u011fi \u00f6ne \u00e7\u0131karan siyaset\u00e7iler -S\u00fcleyman Demirel, Necmettin Erbakan, Alparslan T\u00fcrke\u015f, Turgut \u00d6zal gibi-\u00a0 s\u00f6z\u00fc edilen vesayet\u00e7i yap\u0131n\u0131n ortadan kald\u0131r\u0131lmas\u0131, se\u00e7ilmi\u015f-atanm\u0131\u015f ili\u015fkisinin demokratik kurallara uygun hale getirilmesi ve istikrarl\u0131 bir h\u00fck\u00fcmet yap\u0131s\u0131 i\u00e7in zaman zaman h\u00fck\u00fcmet sisteminin ba\u015fkanl\u0131k sistemine ge\u00e7ilmesi y\u00f6n\u00fcnde de\u011fi\u015fmesi gerekti\u011fi konusunda deme\u00e7ler vermi\u015f ve \u00e7al\u0131\u015fmalar yapm\u0131\u015flard\u0131r. \u00d6zal\u2019\u0131n tek parti h\u00fck\u00fcmetleri d\u00f6neminde ger\u00e7ek manada y\u00fcr\u00fctme yetkisinin ba\u015fbakanl\u0131kta toplanmas\u0131 \u00e7al\u0131\u015fmalar\u0131 yap\u0131lsa da, bu d\u00fczenlemelerin kal\u0131c\u0131 olmayaca\u011f\u0131 d\u00fc\u015f\u00fcncesiyle \u00d6zal, ba\u015fkanl\u0131k sistemi y\u00f6n\u00fcnde bir anayasa de\u011fi\u015fikli\u011fi yap\u0131lmas\u0131n\u0131n ka\u00e7\u0131n\u0131lmaz oldu\u011fu \u00e7a\u011fr\u0131s\u0131nda bulunuyordu. O d\u00f6nem buna muhalefet eden S\u00fcleyman Demirel\u2019in, sonraki s\u00fcre\u00e7te kendi iktidar\u0131 zaman\u0131nda bunu savundu\u011fu da bilinen bir husustur.<\/span><\/p>\n

Bu hususta, yasal d\u00fczeyde y\u00fcr\u00fct\u00fclen \u00e7al\u0131\u015fmalar\u0131n yan\u0131nda anayasa de\u011fi\u015fikli\u011fini gerektiren d\u00fczenleme talepleri de dikkat \u00e7eker. \u015eimdiye kadar ki \u00e7al\u0131\u015fmalar daha \u00e7ok yasal mevzuat\u0131n demokratik siyasete uygun olacak \u015fekilde d\u00fczenlenmesini i\u00e7eren \u00e7al\u0131\u015fmalard\u0131r. Ancak bu \u00e7al\u0131\u015fmalar sistem i\u00e7inde g\u00fc\u00e7 da\u011f\u0131l\u0131m\u0131na sebebiyet verece\u011fi endi\u015fesinden dolay\u0131 kolay ger\u00e7ekle\u015fmemi\u015ftir. Hatta bu \u00e7al\u0131\u015fmalar baz\u0131 d\u00f6nemlerde siyasal krize sebebiyet verecek boyutlara bile ula\u015fabilmi\u015ftir. Bunlardan bir tanesi de MGK\u2019n\u0131n \u00fcye yap\u0131s\u0131n\u0131n de\u011fi\u015ftirilmesine y\u00f6nelik \u00e7al\u0131\u015fmalard\u0131. \u00d6zellikle MGK, kurulun yap\u0131s\u0131 ve genel sekterinin yetkileri kapsam\u0131nda sadece i\u00e7 siyaset a\u00e7\u0131s\u0131ndan de\u011fil Avrupa Birli\u011fi\u2019ne \u00fcyelik ko\u015fullar\u0131 kapsam\u0131nda tart\u0131\u015fma konusuydu. Bu ba\u011flamda MGK\u2019n\u0131n yap\u0131s\u0131n\u0131n de\u011fi\u015ftirilmesinde ulusal siyasette h\u00fck\u00fcmetin iradesi ve \u00e7abalar\u0131 gerekli olmakla birlikte, yeterli olmamaktayd\u0131. Avrupa Birli\u011fi\u2019nin Kopenhag siyasi kriterleri gerek\u00e7e tutularak bu d\u00fczenlemeler i\u00e7in ulusal siyasetin arad\u0131\u011f\u0131 ilave destek sa\u011flanmaya \u00e7al\u0131\u015f\u0131l\u0131yordu. Nitekim MGK\u2019n\u0131n yap\u0131s\u0131nda \u00fcye say\u0131s\u0131n\u0131n se\u00e7ilmi\u015fler y\u00f6n\u00fcnde de\u011fi\u015ftirilmesi ile ilgili d\u00fczenlemeler Avrupa Birli\u011fi kriterleri uyar\u0131nca yap\u0131l\u0131nca, d\u00f6nemin Genel Kurmay Ba\u015fkan\u0131 H\u00fcseyin K\u0131vr\u0131ko\u011flu, \u201cisterse MGK\u2019da sivil \u00fcye say\u0131s\u0131 1000 olsun, orada kararlar oy birli\u011fi ile al\u0131n\u0131r\u201d \u015feklinde bir deme\u00e7 vererek, bir anlamda bu kurulda \u201cbiz ne dersek o olur\u201d mesaj\u0131n\u0131 verme ihtiyac\u0131 duymu\u015ftur. Asl\u0131nda bu deme\u00e7 bize siyasal sistemin g\u00f6r\u00fcn\u00fcrdeki sorumlular\u0131 ile esastaki sahipleri aras\u0131nda birebir bir \u00f6rt\u00fc\u015fmenin olmad\u0131\u011f\u0131n\u0131n, devlet i\u00e7inde bir b\u00f6l\u00fcnmenin varl\u0131\u011f\u0131n\u0131n ifadesidir.<\/span><\/p>\n

MGK\u2019n\u0131n siyaset \u00fczerindeki etkisi, ilgili yasal metnindeki 2. maddede Milli G\u00fcvenlik kavram\u0131na yapm\u0131\u015f oldu\u011fu tan\u0131mla daha iyi anla\u015f\u0131lmaktad\u0131r. Bu maddede milli g\u00fcvenlik \u201cDevletin anayasal d\u00fczeninin, milli varl\u0131\u011f\u0131n\u0131n, b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fcn, milletleraras\u0131 alanda siyasi, sosyal, k\u00fclt\u00fcrel ve ekonomik d\u00e2hil b\u00fct\u00fcn menfaatlerinin ve ahdi hukukunun her t\u00fcrl\u00fc d\u0131\u015f ve i\u00e7 tehditlere kar\u015f\u0131 korunmas\u0131 ve kollanmas\u0131n\u0131\u201d ifade etmek \u00fczere kullan\u0131lm\u0131\u015ft\u0131r. Burada \u00fclkenin sadece g\u00fcvenlik ve asayi\u015f konular\u0131 \u00fczerinde de\u011fil, siyasi, sosyal, iktisadi, d\u0131\u015f ili\u015fkiler \u00fczerinde durulmas\u0131, Milli G\u00fcvenlik \u015femsiyesi alt\u0131nda her alana m\u00fcdahale yetkisini, anayasal h\u00fck\u00fcmlere ra\u011fmen, kendisine tan\u0131maktayd\u0131. B\u00fct\u00fcn bu d\u00fczenlemelerin de\u011fi\u015ftirilmesi \u00e7al\u0131\u015fmalar\u0131, \u00f6zellikle koalisyon h\u00fck\u00fcmetleri d\u00f6neminde siyasi istikrars\u0131zl\u0131k gere\u011fi zor y\u00fcr\u00fcmekteydi. Siyasetteki \u00e7ok par\u00e7al\u0131 yap\u0131lar, bir anlamda sistem i\u00e7inde atanm\u0131\u015flara g\u00fc\u00e7 sa\u011flad\u0131\u011f\u0131 gibi toplum nezdinde me\u015fruiyet de sa\u011flamaktayd\u0131. Onlara g\u00f6re \u201c\u00fclke siyaset\u00e7ilere b\u0131rak\u0131lmayacak kadar \u00f6nemliydi\u201d.<\/span><\/p>\n

Dolay\u0131s\u0131yla siyasetteki her karma\u015fa, onlara sistem i\u00e7inde daha fazla alan a\u00e7ma imk\u00e2n\u0131 sa\u011fl\u0131yordu. Bunun en \u00e7arp\u0131c\u0131 \u00f6rne\u011fi 28 \u015eubat 1997\u2019deki Milli G\u00fcvenlik Kurulu toplant\u0131s\u0131d\u0131r. 8 saat s\u00fcren toplant\u0131 sonucunda halk\u0131n oylar\u0131yla se\u00e7ilmi\u015f bulunan Refah Partisi ve Do\u011fru Yol Partisi koalisyon h\u00fck\u00fcmeti istifaya zorlanm\u0131\u015ft\u0131. Ayr\u0131ca h\u00fck\u00fcmetin iradesine ayk\u0131r\u0131 bir \u015fekilde almas\u0131 gereken \u201ctedbirler\u201d dayatmas\u0131 da yap\u0131lm\u0131\u015ft\u0131. Yani demokratik irade g\u00f6z ard\u0131 edilerek, topluma ra\u011fmen siyasete \u00e7eki d\u00fczen verme aray\u0131\u015flar\u0131 vard\u0131. Bu d\u00f6nemde b\u00fcrokratik alanda etkili olan askeri b\u00fcrokrasinin \u00f6nc\u00fcl\u00fc\u011f\u00fcnde yarg\u0131 b\u00fcrokrasisine, di\u011fer b\u00fcrokratik kesimlerle birlikte medya mensuplar\u0131na brifingler verilerek, temel yasal zeminden ziyade nerede ve nas\u0131l duracaklar\u0131 kendilerine g\u00f6sterilmi\u015fti.<\/span><\/p>\n

G\u00fcd\u00fcml\u00fc siyaset vesayetin emrinde<\/span><\/strong><\/p>\n

Bu heng\u00e2me i\u00e7erisinde devletin ba\u015f\u0131 olarak cumhurba\u015fkan\u0131n\u0131n durmas\u0131 gereken yer me\u015fru demokratik siyaset iken, tercih devlet i\u00e7indeki g\u00fc\u00e7 merkezlerine yak\u0131n durmak \u015feklinde olmu\u015ftur. D\u00f6nemin cumhurba\u015fkan\u0131 bunu en iyi \u015fu \u015fekilde vazetmi\u015ftir: \u201cH\u00fck\u00fcmet \u015fapkaysa, Milli G\u00fcvenlik Kurulu devlettir\u201d. Buradan da anla\u015f\u0131laca\u011f\u0131 \u00fczere sivil siyasetin siyaset yapma, toplumdan ald\u0131\u011f\u0131 yetkiyi kullanabilme zemini zay\u0131ft\u0131. Bu durum asl\u0131nda b\u00fct\u00fcn siyasilerin g\u00fcndeminde olsa bile, siyasi f\u0131rsat\u00e7\u0131l\u0131k sonucu atanm\u0131\u015flar kar\u015f\u0131s\u0131nda birlik olu\u015fturam\u0131yor ve hatta g\u00fcd\u00fcml\u00fc de olsa iktidara gelebilmenin yollar\u0131n\u0131 arama f\u0131rsat\u00e7\u0131l\u0131\u011f\u0131 i\u00e7erisine giriyorlard\u0131. Bunun en \u00e7arp\u0131c\u0131 \u00f6rne\u011fi 28 \u015eubat sonras\u0131 kurulan koalisyon h\u00fck\u00fcmetleridir. Bu d\u00f6nemin \u00f6nemli \u00f6zelli\u011fi hi\u00e7bir siyasi partinin toplum nezdinde tek ba\u015f\u0131na iktidara gelebilecek deste\u011fe sahip olmamas\u0131d\u0131r.<\/span><\/p>\n

2002 \u00f6ncesindeki siyasi krizler, ekonomik krizler, istikrars\u0131z h\u00fck\u00fcmetler, b\u00fcrokratik vesayetin sistem i\u00e7indeki h\u00e2kimiyeti, siyasal sisteme toplumun iradesini yans\u0131tacak bir de\u011fi\u015fimin ger\u00e7ekle\u015fmesinin zorunlulu\u011fu y\u00f6n\u00fcnde bir anlay\u0131\u015f\u0131n olu\u015fmas\u0131na sebep oldu. Recep Tayyip Erdo\u011fan\u2019\u0131n kurdu\u011fu AK Parti\u2019nin siyasi ya\u015fama d\u00e2hil olmas\u0131 ve ilk se\u00e7imlerde tek ba\u015f\u0131na iktidara gelmesi ile topluma hizmet noktas\u0131nda sistemin iyile\u015ftirilmesine d\u00f6n\u00fck \u00e7al\u0131\u015fmalar yeniden g\u00fcndeme geldi. Vesayet\u00e7i yap\u0131n\u0131n tasfiyesi \u00f6zellikle Avrupa Birli\u011fi\u2019ne entegrasyon s\u00fcreci ba\u011flam\u0131nda ger\u00e7ekle\u015ftirilmeye \u00e7al\u0131\u015f\u0131ld\u0131. B\u00fct\u00fcn bu \u00e7al\u0131\u015fmalar sivil siyaset alan\u0131nda olumlu geli\u015fmeler olarak de\u011ferlendirilse de, stat\u00fcko mensuplar\u0131 ve onlar\u0131n siyasetteki uzant\u0131lar\u0131nda rahats\u0131zl\u0131k yaratm\u0131\u015ft\u0131. Siyasi partilerin siyaset yapt\u0131\u011f\u0131 zeminin g\u00fcvensizli\u011fi en az\u0131ndan 2003 ile 2007 aras\u0131nda te\u015febb\u00fcs halinde olan ya da ger\u00e7ekle\u015fen, vesayetin devam\u0131 amac\u0131nda olan anti-demokratik m\u00fcdahalelerde kendini g\u00f6sterdi. 2007 y\u0131l\u0131nda cumhurba\u015fkanl\u0131\u011f\u0131 se\u00e7imine odakl\u0131 Genelkurmay kaynakl\u0131 e-muht\u0131ran\u0131n h\u00fck\u00fcmet taraf\u0131ndan ge\u00e7ersiz k\u0131l\u0131nmas\u0131n\u0131, vesayetin di\u011fer oda\u011f\u0131 olan Anayasa Mahkemesi\u2019nin TBMM\u2019nin cumhurba\u015fkan\u0131n\u0131 se\u00e7mesini imk\u00e2ns\u0131z hale getiren \u201c367 Karar\u0131\u201d takip etti. Demokrat Parti zaman\u0131ndan itibaren toplumun iradesini manip\u00fcle etmek ve siyaseten etkisiz hale getirmek i\u00e7in kullan\u0131lan laiklik gerek\u00e7esine dayanarak Ak Parti\u2019yi kar\u015f\u0131 laikli\u011fe ayk\u0131r\u0131 g\u00fc\u00e7lerin oda\u011f\u0131 oldu\u011fu gerek\u00e7esiyle Anayasa Mahkemesi\u2019nde kapatma davas\u0131 a\u00e7\u0131ld\u0131. Bir kez daha siyaset, siyaset d\u0131\u015f\u0131 yollarla \u201chukuk\u201d vas\u0131tas\u0131yla dizayn edilmeye \u00e7al\u0131\u015f\u0131ld\u0131. Ancak Anayasa Mahkemesi\u2019nin kapatma davas\u0131nda k\u0131l pay\u0131 bir kararla Ak Parti\u2019nin devam\u0131na karar vermesi, T\u00fcrkiye\u2019de sivil siyasetin yasalar nezdinde g\u00fcvence de olmad\u0131\u011f\u0131n\u0131 g\u00f6stermi\u015fti.<\/span><\/p>\n

\u00d6zellikle Abdullah G\u00fcl\u2019\u00fcn cumhurba\u015fkan\u0131 se\u00e7ilmesi s\u00fcreci bu konuda belirleyici bir etki yaratm\u0131\u015f ve konunun sadece yasal d\u00fczenlemeler d\u00e2hilinde bir g\u00fcvence te\u015fkil etmeyece\u011fini ve anayasa de\u011fi\u015fikli\u011finin acil bir \u015fekilde yap\u0131lmas\u0131 gerekti\u011fini g\u00f6sterdi. Normal yasal usullerle yap\u0131lmas\u0131 gereken se\u00e7imlerin zorlama hukuki yorumlarla akamete u\u011frat\u0131lmas\u0131, daha \u00f6nce \u00fc\u00e7 defa ayn\u0131 usullerle yap\u0131lan se\u00e7imlerde aranmayan zorlama \u015fartlar getirilmesi, bunun yarg\u0131\u00e7lar vas\u0131tas\u0131yla anayasal bir ko\u015ful gibi ileri s\u00fcr\u00fclmesi, cumhurba\u015fkanl\u0131\u011f\u0131 makam\u0131n\u0131n anayasal se\u00e7ilme \u015fartlar\u0131n\u0131 ta\u015f\u0131yan her siyaset\u00e7iye a\u00e7\u0131k olamayaca\u011f\u0131n\u0131 ve T\u00fcrkiye\u2019de se\u00e7ilmi\u015f siyasetin zinde g\u00fc\u00e7ler kar\u015f\u0131s\u0131nda sadece oylar\u0131yla bir g\u00fcvencede olmad\u0131\u011f\u0131 ger\u00e7e\u011fiyle bir kez daha kar\u015f\u0131 kar\u015f\u0131ya b\u0131rakm\u0131\u015ft\u0131. S\u00f6zde milletin egemenli\u011fi ilkesi, bir tak\u0131m yasal bo\u015fluklar ve anayasaya ayk\u0131r\u0131 d\u00fczenlemelerle kontrol alt\u0131nda tutulmaya \u00e7al\u0131\u015f\u0131lm\u0131\u015ft\u0131. Bu durum anayasal d\u00fczeyde de\u011fi\u015fiklik yap\u0131lmas\u0131n\u0131n zaruretini bir kez daha ortaya koymu\u015ftu.<\/span><\/p>\n

Yukar\u0131da ifade edilen MGK ile ilgili d\u00fczenlemeler ve yasal mevzuat\u0131n\u0131n de\u011fi\u015ftirilmesi Ak Parti iktidar\u0131 zaman\u0131nda yap\u0131lm\u0131\u015ft\u0131. Ancak, yine yukar\u0131da da ifade etti\u011fimiz gibi, yasal mevzuat \u00fczerindeki de\u011fi\u015fiklikler g\u00fcvence te\u015fkil etmiyordu. Bunun anayasal zemin \u00fczerinden yap\u0131larak kal\u0131c\u0131 hale getirilmesi \u00f6nemliydi. Ak Parti bunun zeminini yoklamaya ve siyasal partilere bu \u00e7a\u011fr\u0131lar\u0131 yapmaya ba\u015flad\u0131. Hatta ideolojik olarak Ak Parti\u2019ye kar\u015f\u0131 yap\u0131lan baz\u0131 ithamlar ve g\u00fcvensizlikleri (gizli g\u00fcndemi var vs.) gidermek i\u00e7in, muhalefetin de onay verece\u011fini d\u00fc\u015f\u00fcnd\u00fc\u011f\u00fc sayg\u0131n anayasa hukuk\u00e7ular\u0131na anayasal metinler, taslaklar haz\u0131rlatarak, bir taraftan yetkisi d\u00e2hilinde yasal d\u00fczenlemeleri yaparken di\u011fer taraftan anayasa de\u011fi\u015fikli\u011fi i\u00e7in gerekli \u00e7o\u011funlu\u011fu temin etmeye \u00e7al\u0131\u015ft\u0131.<\/span><\/p>\n

Se\u00e7ilmi\u015f iktidar\u0131n, biraz da koalisyon h\u00fck\u00fcmeti olmamas\u0131n\u0131n da etkisiyle, sorunu topluma ta\u015f\u0131mas\u0131 ve anayasa da ifade edilen \u201cegemenli\u011fin kay\u0131ts\u0131z \u015farts\u0131z milletindir\u201d h\u00fckm\u00fcne i\u015flerlik kazand\u0131rmas\u0131, uzun s\u00fcredir \u00fclkede egemen kimdir sorusunun cevab\u0131n\u0131 netle\u015ftirecek ad\u0131mlar\u0131n at\u0131lmas\u0131na kap\u0131 aralam\u0131\u015f oldu. Yap\u0131lan erken se\u00e7imle bir kez daha halktan yetki alan Ak Parti, referanduma sundu\u011fu anayasa de\u011fi\u015fikli\u011fi ile her zaman siyasette kriz haline gelen cumhurba\u015fkanl\u0131\u011f\u0131 se\u00e7imini do\u011frudan halk taraf\u0131ndan se\u00e7ilme kural\u0131na ba\u011flayarak farkl\u0131 bir duruma getirdi. Cumhurba\u015fkan\u0131na siyasal sorumluluk y\u00fckledi. Nitekim bu h\u00fck\u00fcm do\u011frultusunda 1961 Anayasas\u0131 sonras\u0131nda ilk kez Cumhurba\u015fkan\u0131 Recep Tayyip Erdo\u011fan cumhurba\u015fkanl\u0131\u011f\u0131 makam\u0131na do\u011frudan halk\u0131n % 51 oyuyla gelmi\u015f oldu. Se\u00e7im usul\u00fcndeki bu de\u011fi\u015fiklik, cumhurba\u015fkan\u0131n\u0131n se\u00e7imi krizine bir \u00e7\u00f6z\u00fcm sunmu\u015f olsa da, yeni d\u00fczenlemelerin yap\u0131lmas\u0131na aciliyet kazand\u0131rd\u0131.<\/span><\/p>\n

Zira referanduma sunulan cumhurba\u015fkan\u0131n\u0131n se\u00e7im usul\u00fc idi. Cumhurba\u015fkan\u0131na 1982 Anayasas\u0131\u2019nda tan\u0131nan yetkiler aynen yerinde durmaktayd\u0131. Bu yetkiler sorumluluk ile tan\u0131mlanmam\u0131\u015ft\u0131. Dolay\u0131s\u0131yla cumhurba\u015fkan\u0131n\u0131n se\u00e7ilmesi halk\u0131n do\u011frudan oyu ile sa\u011flanacak ancak y\u00fcr\u00fctmede iki ba\u015fl\u0131l\u0131ktan kaynaklanan sorunlara \u00e7\u00f6z\u00fcm olmayacakt\u0131. Nitekim siyasal tarihimiz iki ba\u015fl\u0131l\u0131ktan kaynaklanan \u00e7at\u0131\u015fmalar\u0131n yol a\u00e7t\u0131\u011f\u0131 siyasi krizler ve istikrars\u0131zl\u0131k \u00f6rneklerini bar\u0131nd\u0131r\u0131r. Cumhurba\u015fkan\u0131 ve ba\u015fbakan\u0131n ayn\u0131 siyasi e\u011filime sahip olmalar\u0131 bile bu \u00e7at\u0131\u015fmay\u0131 engellemeye yetmemi\u015ftir. Bu bak\u0131mdan sadece yasama, y\u00fcr\u00fctme ve yarg\u0131 aras\u0131ndaki ili\u015fkilerin d\u00fczenlenmesi de\u011fil, yasama, y\u00fcr\u00fctme ve yarg\u0131n\u0131n kendi i\u00e7inde de d\u00fczenlemelerin yap\u0131lmas\u0131 demokratik siyaset a\u00e7\u0131s\u0131ndan zorunluluk arz etmektedir. Bu d\u00fczenlemelerin toplumun e\u011filimlerini, iradesini yans\u0131tacak bir \u015fekilde olmas\u0131 ve sivil siyasetin de ge\u00e7mi\u015fte oldu\u011fu gibi atanm\u0131\u015f kesimlerin m\u00fcdahalelerine maruz kalmamas\u0131 i\u00e7in anayasal d\u00fczeyde ger\u00e7ekle\u015ftirilmesi ve halka dayal\u0131 olmas\u0131 siyasal sistemin gelece\u011fi a\u00e7\u0131s\u0131ndan elzem olmu\u015ftur. Bu a\u00e7\u0131dan cumhurba\u015fkan\u0131n\u0131n do\u011frudan halk taraf\u0131ndan se\u00e7ilmesi ilkesi ile siyasal sorumluluk y\u00fcklenen cumhurba\u015fkan\u0131, demokratik hukuk devletinin gere\u011fi olarak anayasa de\u011fi\u015fiklik \u00f6nerisi ile siyasal tarihimizde ilk kez cezai sorumluluk ile de y\u00fck\u00fcmlendirilecektir.<\/span><\/p>\n

T\u00fcrkiye \u015fimdiye kadar ya\u015fad\u0131\u011f\u0131 sorunlar\u0131 devlet i\u00e7erisinde sergilenen g\u00fc\u00e7 oyunlar\u0131 \u00fczerinden de\u011fil, \u00f6teden beri anayasalar\u0131m\u0131zda var olan h\u00fck\u00fcm gere\u011fi, halk\u0131 hakem tayin ederek \u00e7\u00f6zebilece\u011fini bizzat tecr\u00fcbe ederek bu noktaya ula\u015ft\u0131. \u00a0Bu tecr\u00fcbenin anayasal g\u00fcvence ile ta\u00e7land\u0131r\u0131lmas\u0131 2001 M\u0130T krizi, 17 ve 25 Aral\u0131k \u00f6rt\u00fcl\u00fc darbe te\u015febb\u00fcslerinde oldu\u011fu gibi devlet i\u00e7inde \u00e7\u00f6reklenmi\u015f bir tak\u0131m g\u00fc\u00e7lerin me\u015fru zemin d\u0131\u015f\u0131ndaki g\u00fc\u00e7 oyunlar\u0131n\u0131 engelleyecek, keyfi g\u00fc\u00e7 kullan\u0131mlar\u0131n\u0131 s\u0131n\u0131rlayacakt\u0131r. Se\u00e7ilmi\u015f iktidar b\u00fct\u00fcn bu keyfi g\u00fc\u00e7 kullan\u0131mlar\u0131n\u0131 halk\u0131n hakemli\u011fine ba\u015fvurarak bertaraf etmeye \u00e7al\u0131\u015fm\u0131\u015ft\u0131r ki, demokratik siyaset a\u00e7\u0131s\u0131ndan me\u015fru yol budur. Bu te\u015febb\u00fcslerin her defas\u0131nda halka gidilerek atlat\u0131lmas\u0131 demokratik siyasete olan g\u00fcveni peki\u015ftirmi\u015ftir. Ancak se\u00e7ilmi\u015f siyasetin s\u00fcrekli bu tarz i\u015flerle me\u015fgul olmamas\u0131 ve asli i\u015fleriyle u\u011fra\u015fmas\u0131 i\u00e7in devlet i\u00e7inde de demokratik anayasal d\u00fczene i\u015flerlik kazand\u0131r\u0131lmas\u0131, resmi hiyerar\u015fi d\u0131\u015f\u0131ndaki odaklara ba\u011fl\u0131 unsurlar\u0131n kanunlar d\u00e2hilinde tasfiyesi zorunludur. H\u00e2kimler ve Savc\u0131lar Y\u00fcksek Kurulu\u2019nun yap\u0131s\u0131 ve se\u00e7imi i\u00e7in \u00f6nerilen de\u011fi\u015fikli\u011fin temel amac\u0131 budur. Aksi hal demokratik siyaset a\u00e7\u0131s\u0131ndan ge\u00e7mi\u015fte oldu\u011fu gibi tehdit olu\u015fturmaya devam edecektir. Nitekim 15 Temmuz 2017 darbe te\u015febb\u00fcs\u00fcyle bu g\u00fc\u00e7 odaklar\u0131ndan biri olan FETO denilen \u00f6rg\u00fct\u00fcn sistem i\u00e7inde resmi hiyerar\u015fi d\u0131\u015f\u0131 \u00f6rg\u00fctlenmesinin \u00fclke g\u00fcvenli\u011fi ve siyaseti i\u00e7in yapt\u0131\u011f\u0131 tahribatlara benzer tahribatlara maruz b\u0131rakacakt\u0131r ki, gelecek a\u00e7\u0131s\u0131ndan bu g\u00fcvensizlik demektir. Haliyle devlete de\u011fil de topluma dayal\u0131 siyasete \u00f6ncelik verecek d\u00fczenlemeler yap\u0131lmas\u0131 demokratik siyasetinin varl\u0131\u011f\u0131 i\u00e7in elzemdir. Anayasa de\u011fi\u015fikli\u011fi \u00f6nerisinde ifadesini bulan h\u00fck\u00fcmet sistemi de\u011fi\u015fikli\u011fi, vesayet\u00e7i yap\u0131n\u0131n kal\u0131nt\u0131lar\u0131n\u0131 tasfiye etmeyi ve siyasal kat\u0131l\u0131m\u0131n \u00e7er\u00e7evesini geni\u015fleterek istikrarl\u0131 h\u00fck\u00fcmet olu\u015fturma yoluyla y\u00f6netebilen demokrasiyi ger\u00e7ekle\u015ftirmektir.<\/span><\/p>\n
